Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the services offered by Apex Rotors ("us," "we," or "our").

Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all clients, visitors, and others who access or use our services. By hiring Apex Rotors for any service, you agree to be bound by these Terms.

Services
Apex Rotors provides professional drone-based aerial photography and videography services, including but not limited to real estate photography, event videography, and construction site progression monitoring (the "Services"). The specific scope of services for each project will be detailed in a written quote or service agreement provided to the client (the "Client").

Quotes, Booking, and Payment

• Quotes: All quotes provided are valid for 30 days from the date of issue. Quotes are based on the information provided by the Client. Any changes to the project scope may result in a revised quote.

• Booking: To secure a date and book our Services, the Client must formally accept the quote and pay a non-refundable deposit of 25% of the total estimated cost.

• Payment: The remaining balance is due upon delivery of the final media files, unless otherwise specified in the service agreement. We reserve the right to withhold delivery of all media until full payment has been received. Payments can be made via the online invoice system.

Cancellations and Rescheduling

• Client Cancellation: If the Client cancels a booked service, the initial non-refundable deposit will be forfeited. Cancellations made within 48 hours of the scheduled service date may be subject to a cancellation fee of up to 50% of the total project cost.

• Weather Postponement: The safety of our operations is paramount. We cannot operate in unsafe weather conditions, including but not limited to high winds, rain, fog, or extreme temperatures. The pilot-in-command will make the final determination on whether conditions are safe for flight. If a flight must be postponed due to weather, we will work with the Client to reschedule at the earliest available opportunity at no additional cost. The non-refundable deposit will be applied to the rescheduled date.

Flight Operations

• Safety & Legality: All drone operations will be conducted in accordance with all applicable Federal Aviation Administration (FAA) regulations and local laws. The remote pilot-in-command (RPIC) has final authority on all flight operations and may terminate a flight at any time if they deem the conditions to be unsafe or the operation to be illegal.

• Airspace & Permissions: We will conduct a pre-flight assessment to ensure the location is in safe and legal airspace. The Client is responsible for securing any and all necessary permissions from property owners, venue managers, or other relevant authorities to allow our drone operations on-site.

Deliverables & Turnaround Time

• Delivery: Final edited photos and/or videos ("Media") will be delivered to the Client as high-resolution digital files via a secure download link.

• Turnaround: Our standard turnaround time is approximately 3-7 business days from the date of the flight. This may vary depending on the scope of the project and will be specified in the service agreement.

• Editing: The delivered Media will be edited for quality, including color correction and basic enhancements. Any requests for advanced editing or re-editing may be subject to additional fees.

Copyright and Licensing

• Copyright Ownership: Apex Rotors retains the full copyright to all Media we create. All rights not expressly granted to the Client are reserved by Apex Rotors.

• Usage License: Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable license to use the delivered Media for the purposes specified in the service agreement (e.g., real estate listing, company website, social media marketing).

• Prohibited Uses: The Client may not sell, re-license, or transfer the Media to any third party without prior written consent from Apex Rotors.

• Promotional Use: We reserve the right to use any Media for our own promotional purposes, including on our website, social media, and in our portfolio, unless a separate non-disclosure agreement has been signed.

Limitation of Liability
To the maximum extent permitted by law, Apex Rotors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our Services. Our total liability for any claim arising out of or relating to our Services is limited to the amount paid by the Client for the Services rendered.

Indemnification
The Client agrees to indemnify and hold harmless Apex Rotors and its personnel from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with the Client's breach of these Terms or failure to secure necessary site permissions.

Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions.

Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes on our website.
